1. Who is responsible for protecting your personal data

BH BIKES EUROPE, S.L. (hereinafter BH BIKES) is responsible for this website and all (mobile) applications referred to in this Privacy Policy. BH Bikes agrees to take full responsibility for the protection and security of your personal data.

All of our activities are based on strict ethical principles and we are committed to protecting the privacy of everyone who visits our website and our (mobile) applications. Therefore, the way we collect and store information depends on how our website and its related services are used.

 2.2 Data provided by you

In addition to the data that is collected automatically, we also process the data that you provide to us. This includes, but is not limited to:

_ Your contact information, including your full name, your address (billing or delivery), your date of birth and email address and, optionally, your telephone number. We need your email address and (optionally) your telephone number so that we can contact you if we have questions or information about your order.

_ Other information necessary to process your order, such as information about the products that you have ordered, the billing and delivery address and your bank or credit card details.

_ If you have created an online profile, the preferences and interests saved in this profile (see the additional information about profiles below).

_ If you have contacted customer services, the details and record of that contact.

All of this data is characterised because it is you who provides the information. We use this information for the purposes described in this privacy policy. You may correct and object to the continued processing of your personal data at any time (see section 5).

3. How we use the collected data

We will use your personal data for purposes related to your order; for example, to inform you of the status of your order or delivery, provide our technical support service or provide warranty services. We may use your data to assess your creditworthiness, for which we will contact third parties.

If you have provided us with your personal data in relation to a promotion, event, (mobile) application, etc., we may send you emails and other messages related to the service that you have requested.

If you contact our customer services, we will use your personal data (including your contact history) to allow the customer services department to process your order and provide the best possible service.

If you have provided us with your personal data during the sale of a product or service, we will inform you of other, similar products or services. We may also contact you to ask for your opinion after selling you a product or service. If a sales process is interrupted, we will send you an email reminder. You can unsubscribe from any of these notifications immediately and free of charge by clicking on a link in the respective email or other message (see section 5 below).

With your express consent, we may contact you using the contact information you have provided (including by post, email, SMS, telephone or any other electronic means) for BH Bikes marketing, advertising and opinion research purposes. For example, this includes information about BH Bikes’ products, e-commerce activities, special offers, promotions and information about local store openings, activities in BH Bikes’ local stores or sporting events. To allow us to contact you regarding information that is of special interest to you, we will analyse and use all of your general interaction with BH Bikes (for example, your buying behaviour in our online stores, in BH Bikes’ physical stores, your use of loyalty programmes, your ratings and assessments of products, your contact history with our customer services department, your newsletter open rates and clicks, your browsing behaviour (web tracking), the types of newsletters to which you are subscribed, your participation in promotions and events, your interactions with My Coach and your use of our (mobile) applications). We may provide your contact information to BH Bikes for marketing, advertising and opinion research purposes. Section 5 contains information about your rights, e.g. how you can withdraw your consent or correct your personal data.

4. Disclosure of information

One of our core principles is that we will treat your data with care and confidentiality. We will not sell your data to third parties. Your data will be disclosed to third parties if so required by law. We may transfer your data to other companies in the BH Group, whenever the applicable legislation so permits.

We may use service providers and data processors who work on behalf of BH Bikes. The services may include system hosting and maintenance services, analytics services, email messaging services, delivery services, payment transaction management, credit and address checks, etc. Third parties are given access to the personal data that they require to provide the relevant service. The service providers and data processors are contractually obliged to treat the information with the strictest confidentiality. They are also contractually forbidden from using the data in any way other than required. The necessary steps have been taken to ensure that the service providers and processors that work on behalf of BH Bikes protect the confidentiality of your data.

There may be times when we disclose non-personal data to our partners anonymously. For example, this data includes information about the number of visitors to a website or (mobile) application during a specific period of time. Generally, this information is only disclosed in summarised form.

5. Your rights

If you provide us with your personal data through our websites or other channels, this is done completely voluntarily. If you choose not to provide the requested information, you will not be able to access certain customer benefits. In some cases, only people who have provided us with the necessary personal data will be able to order products, use certain services and take advantage of other kinds of activities and offers available on our website and (mobile) application. Since we believe that transparency and fairness are especially important issues, we offer several options depending on the specific circumstances, to help you to keep control of your data. These options may include displaying and editing your data online. They may also include unsubscribing from certain services or deleting user accounts or removing information about the stored data.

5.1 Right to object and unsubscribe

The emails that BH Bikes sends you that contain such things as newsletters or marketing content, include the option to unsubscribe and stop receiving those emails, by following the relevant instructions in the respective email. If you want to stop receiving our emails, you can click on that ‘unsubscribe’ hyperlink and we will no longer send you any more emails.

If you do not want us to collect and analyse information about your behaviour on our website or (mobile) application, you can choose to be excluded from data collection for web analytics, as described below in section 9.

If you do not want to receive information about promotions and offers in general, including that provided by post, email, SMS, telephone or any other electronic means, or if you wish to withdraw your consent, you may also write to BH BIKES EUROPE, S.L – Perretagana, 10 – 01015 VITORIA, SPAIN (with the reference: data protection) at any time, or send an email via the link to our Customer Services Department: info@bhbikes.com. If we have any doubts about your identity, we may ask you to provide identification (for example, by sending a copy of your passport). Unlike other regular costs for contacting us, this is free of charge.

Regarding any other types of messages that you may receive, such as maintenance announcements or administrative notifications, you can only stop receiving these messages if you delete your account, since these messages are a compulsory part of user accounts and the ability to use our websites and (mobile) applications. You can also delete your account by sending an email via the link to our Customer Services Department: info@bhbikes.com .

5.2 Right of access

At all times, you have the right to be informed about your personal data that is being stored, its source and its recipients and the purpose for which that data is being stored. You can obtain information about the personal data that we store by using the contact details in the Contact Information section that appears below.

You have the right to request the correction, erasure, deletion or restriction of the personal data stored about you. Within ten days of receiving your request, we will inform you if we are going to accept your request and, if so, to what extent. 7. Protection of children’s personal data

Protecting children’s personal data is extremely important. BH Bikes believes that it is responsible for protecting the privacy of children and, consequently, it does not intend to collect data from children under the age of 18. We encourage parents and other caregivers to browser the internet together with their children and enjoy the internet responsibly.

If a child under the age of 18 tries to register and make a purchase, the parents’/caregivers’ consent will be requested to confirm this process. The data provided and collected about the child during the course of their visit (for example, by cookies) may be used as described above.

 Therefore, we ask parents and other caregivers to monitor and supervise their children’s use of the internet so that we can protect them.

8. Social media

Our website and (mobile) applications provide social media connectors to several social media sites. When you choose to interact with a social media site, your activity on our website or through our (mobile) applications will also be disclosed to social media sites like Facebook and Twitter.

If you have logged into one of these social media sites while you are visiting our website or (mobile) applications, the social media site may add that information to your profile. If you interact with one of the social media connectors, that information will be transferred to the social media site. If you don’t want that data transfer to take place, log out of your social media account before visiting our websites or (mobile) applications.

 9. Geolocation services

We offer location services in some of our (mobile) applications, e.g. Google Maps and Bing Maps. If you use these (mobile) applications, they may receive information about your actual location (e.g. using GPS signals sent by your mobile device) or information that can be used to determine your approximate location. You can generally enable or disable the location services on your device or in your browser’s settings.

 We use the Google Maps or Bing Maps service to help you to find the nearest BH Bikes store. To facilitate this process, we load an image of Google Maps or Bing Maps and we store the route data and the map image on our server.

10. Retargeting technologies

 Our website and (mobile) application use online retargeting technology. This allows us to show our visitors – who were interested in our store and our products – our advertisements on our partners’ websites. We believe that displaying personalised advertising, based on the user’s interests, is more beneficial for our customers than advertisements with no personal connection to them.

 Furthermore, we work with other companies that use tracking technologies to display online advertisements on our behalf. These companies may collect information about your visits to our website or (mobile) applications and your interactions with the messages that we send, including advertising.

 Retargeting technologies analyse your cookies and show advertisements based on your browsing behaviour. For further information about cookies, see section 2 of this privacy policy.

 We do not use this technology to store personal data about you and our use of retargeting technology complies with the applicable data protection requirements.

 BH Bikes is committed to respecting the fundamental principles of privacy and data protection. Therefore, we regularly review this privacy policy to keep it up-to-date and adhere to the principles of privacy and data protection.

This privacy policy may be changed regularly, to adapt it to any changes and opportunities offered by the internet and keep it in line with the current legislation. Any significant changes to the policy will be published on our website, with an updated version of the privacy policy.
